Shipping, Returns, Guarantees

Whenever MOTORBIKE DEVELOPMENTS, S.L. sends you the purchased goods, it is understood that the risk of loss or damage to them will be transferred to you when you or a third party designated by you, other than the carrier contracted by MOTORBIKE DEVELOPMENTS, S.L., acquires physical possession of them.

If you receive the package with signs of tampering or damage, please indicate this on the carrier’s delivery note and check the products in the presence of the carrier. Do not sign the delivery note without indicating these incidents, even if you check that the material appears to be in perfect condition.

IMPORTANT NOTE: MOTORBIKE DEVELOPMENTS, S.L. will not accept claims regarding shipments after 24 hours from receipt of the package, within which time the customer must make the claim via email to info@upbikers.com.

2.- RETURNS

2.1.- Information about your right of withdrawal

We wish to inform you that as a consumer or user under current legislation, you have the right to withdraw from this contract within 15 calendar days without giving any reason.

The withdrawal period will expire 15 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquires physical possession of the goods.

To exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement that you can send us by email to info@upbikers.com indicating the order number. There is a model withdrawal form in section 2.2 below, although its use is not mandatory.

2.2.- Model withdrawal form

For the attention of MOTORBIKE DEVELOPMENTS, S.L.:

I hereby inform you that I am withdrawing from my contract for the sale of the following item:

– Order no. (…)

– Name of consumer and user

– Consumer’s address

– Date

2.3.- Conditions for returning goods

Returned products must be in perfect condition, with all labels attached, in their original packaging and with the manuals, accessories or promotional gifts included, if applicable. Seals or blister packs, if any, must be retained and not removed.

THE PRODUCT TO BE RETURNED MUST BE PACKAGED IN ITS ORIGINAL PACKAGING, ENSURING THAT IT IS PACKED IN THE SAME WAY AS IT WAS RECEIVED, to ensure that it is not damaged in transit. It is very important that you do not put adhesive tape on the product packaging. First wrap the item in similar packaging to that used by MOTORBIKE DEVELOPMENTS, S.L. If the product arrives in a condition contrary to that indicated, MOTORBIKE DEVELOPMENTS, S.L. may refuse to refund the amount of the product and reserve the right to apply a deduction of up to 20% for breakage or damage to the original packaging, with the customer assuming the cost of shipping, or if you do not agree, we will return the product to you.

Improper use of any product, beyond what is normal in a motorcycle accessories store, for example, marks on the sole of UPBIKERS, will be considered an abuse of the right of withdrawal and, in these cases, MOTORBIKE DEVELOPMENTS, S. L reserves the right to devalue the product or refuse to accept the return if the product does not arrive at our facilities in optimal condition that allows it to be resold as an item.

In the case of purchasing a product that comes with a free gift or extra discount for the purchase of the first item, when exercising the right to withdraw from the purchase, the customer must also return any associated promotions or gifts, and if the customer decides not to return any of the products, they must pay for them at the price listed on the website (http://www.upbikers.com) at that time.

2.4.- Consequences of withdrawal

In the event of withdrawal on your part, we will proceed to refund you using the same means of payment used by you for the initial transaction, unless you expressly indicate otherwise. The refund will not be made until we have received and checked the goods at our premises, ensuring that the conditions set out in the previous section have been met.

In the case of order returns, the customer must return or deliver the goods directly by their own means to MOTORBIKE DEVELOPMENTS, S. L., Calle Jesús, 69-10ª 46007 Valencia, without undue delay and, in any case, within a maximum period of 14 calendar days from the date on which you notify us of your decision to withdraw from the contract.

The direct cost of the return will be borne by the customer.

You will be responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish the nature of the goods and their characteristics, beyond what is considered normal in our own facilities. In such cases, the amount of the reduction in value will be deducted from the refund of the payment received from you.

Likewise, when returning the material to us, it is very important that you do not stick labels or seals on the original product box. You must wrap/pack the product in a bag or box before handing it over to the courier or post office. Failure to do so will result in a reduction in value when we refund your money.

2.5.- Direct costs of returning the goods

The shipping costs to MOTORBIKE DEVELOPMENTS, S.L. for the products that the customer wishes to return will be borne by the customer.

If the customer decides to exercise their right of withdrawal and, at the time of purchase, the customer had opted for free shipping, these shipping costs will be deducted from the total amount to be refunded, in accordance with the following criteria:

FOR MAINLAND SPAIN AND PORTUGAL: *€12 VAT included.

FOR THE BALEARIC ISLANDS, CANARY ISLANDS, CEUTA, AND MELILLA: *€12 VAT included.

FOR FRANCE, THE UNITED KINGDOM, ITALY, BELGIUM, THE NETHERLANDS, LUXEMBOURG, AND GERMANY: *€12 VAT included.

3-PRECAUTIONS TO BE TAKEN INTO ACCOUNT WHEN RETURNING AN ITEM

The product to be returned to MOTORBIKE DEVELOPMENTS, S.L. will be the responsibility of the customer and must be wrapped in perfect condition so that both the product and the original packaging are not damaged during transport, in the same way that MOTORBIKE DEVELOPMENTS, S.L. carries out the shipment, as the product must then be in perfect condition to be resold.

If the product arrives in a condition contrary to that indicated, MOTORBIKE DEVELOPMENTS, S.L. will deduct 20% for breakage or damage to the original packaging of the product.

4-PRECAUTIONS TO BE TAKEN INTO ACCOUNT AT THE TIME OF DELIVERY

If you receive the package with signs of tampering or damage, please indicate this on the delivery note and check the products in the presence of the delivery person. Do not sign the delivery note without indicating these incidents, even if you check that the material appears to be in perfect condition.

IMPORTANT NOTE:

We cannot accept claims for shipments more than 24 hours after receipt of the package. The claim must be made by email to: info@upbikers.com.

No products will be reshipped until the receipt and condition of the product, packaging, and accessories of the item subject to return or exchange have been verified at our warehouse.

5- WARRANTIES

MOTORBIKE DEVELOPMENTS, S.L. offers a contractual warranty on its products under the terms established by law for a period of two years from the date of delivery, except for products for which a different period is indicated.

You have a legal obligation to inform us of any lack of conformity of the product within two months of becoming aware of it. Failure to do so will make you liable for any damages caused by the delay in notification.

MOTORBIKE DEVELOPMENTS, S.L. will cover all transport costs during the 2-year period of the contractual warranty from the date of delivery of the product. If the warranty is denied, the customer will be responsible for the shipping costs to the manufacturer and the return to their address.

IMPORTANT: In order to process a warranty claim, it is essential to have the purchase invoice, as this is the proof of purchase of the product.

Notwithstanding the above, the warranty extends solely and exclusively to manufacturing or composition defects in UPBIKERS.

In the case of straps, as they are subject to wear and tear and their useful life cannot be determined with accuracy, they are only guaranteed for a maximum period of 6 months from the date of receipt of the product by the customer.
